Urban Technology Ltd (“Urban”, “us” or “we”), a company incorporated in England/Wales under registration number 10541106 and with registered address at 71-75 Shelton Street, Covent Garden, London, WC2H 9JQ, United Kingdom, is committed to protecting and respecting your privacy.

 

SCOPE OF POLICY:  

This policy (together with our Terms of Use as set out at https://www.deseedating.com & https://www.desee.dating) (“EULA”) and any additional terms of use incorporated by reference into the EULA; e.g, the Cookie Policy (together “our Terms of Use”), applies to your use of Desee Dating mobile application software (“App”) once you have downloaded a copy of the App onto your mobile telephone or portable device (“Device”) and/or your use of the internet websites https://www.deseedating.com & https://www.desee.dating (”Websites”) (the App and the Websites collectively the ”Platform”).

 

This policy sets out the basis on which any personal data we collect from you, or that you provide to us, will be processed by us. Please read the following carefully to understand our views and practices regarding your personal data and how we will treat it. By downloading and using the App and/or the Websites you are accepting and consenting to the practices described in this policy. For the purpose of the Data Protection Act 1998, the data controller is Urban.

 

Information We May Collect From You- We may collect and process the following data about you:  

 

Information you give us (”Submitted Information”): You may give us information about you by filling in forms on the Platform or by corresponding with us (for example, by e-mail or chat). This includes information you provide when you download or register to use the Platform, subscribe to any of our Services, share data via the Platform’s social media functions, or when you report a problem with the Platform or our Services. The information you give us may include your name, address, e-mail address and phone number, the Device’s phone number, age, date of birth, identification code, password and other registration information, personal description, photographs, video streams, etc. The legal basis for the collection and processing of this information is your volutary consent; our legitimate interests, namely the proper administration of the Platform and our business; and/or the performance of a contract between you and us and/or taking steps, at your request, to enter into such a contract.  

Content you upload to the Platform (”Content Information”): You may provide information about you by uploading information to the Platform such as personal description, photographs, video streams, etc. The legal basis for the collection and processing of this information is your voluntary consent.  

• Information we collect via the App about you and your device: Each time you use our App we may automatically collect the following information.  

• technical information, including the type of mobile device you use, a unique device identifier (for example, your Device’s IMEI number, the MAC address of the Device’s wireless network interface, or the mobile phone number used by the Device), mobile network information, your mobile operating system, the type of mobile browser you use and your time zone setting  (Device Information);

• information stored on your Device; or  

• details of your use of the Platform (Log Information).  

• The legal basis for the collection and processing of this information is our legitimate interests, namely the proper administration of the Platform and our business; and for the purposes of analysing the use of the Platform and services.  

• Information we collect via the Websites about you: Each time you use the Platform we may automatically collect the following information  

• technical information, including your IP address, geographical location, browser type and version, operating system, time zone setting, referral source, length of visit, page views and app/websites navigation paths, as well as information about the timing, frequency and pattern of your service use (Log Information).  

• The legal basis for the collection and processing of this information is our legitimate interests, namely the proper administration of the Platform and our business; and for the purposes of analysing the use of the Platform and services.  

• Location information: We may use GPS technology to determine your current location. Some of our Services may require your personal data to work. You will be asked to consent to your data being used for this purpose. You can withdraw your consent at any time by selecting the settings button from the App’s main menu and turning off visibility, however doing so will mean you will be unable to use the App or the Services.  

• The legal basis for the collection and processing of this information is your voluntary consent.  

• Information we receive from other sources (Third Party Information): We are working closely with third parties (including, for example, business partners, sub-contractors in technical, payment and delivery services, advertising networks, analytics providers, search information providers and credit reference agencies) and may receive information about you from them. Please refer to our Cookie Policy for further information.  

• The legal basis for the collection and processing of this information is your voluntary consent; our legitimate interests, namely the proper administration of the Platform and our business; and for the purposes of analysing the use of the Platform and services.  

If you contact us, we may keep a record of that correspondence.

 

Cookies- We use cookies to distinguish you from other users of the Platform. This helps us to provide you with a good experience when you use the Platform and also allows us to improve the Platform. Please refer to our Cookie Policy.

 

Uses Made of the Information.  We use information held about you in the following ways:  

• Submitted Information: To secure the proper administration of the Platform and our business; and/or to be able to perform a contract between you and us and/or taking steps, at your request, to enter into such a contract.  

• Content Information and Location Information: To be able to perform a contract between you and us and/or taking steps, at your request, to enter into such a contract.  

• Device Information and Log information: To conduct research and analysis of the Service to ensure the highest standards of services and identify areas for improvement and to provide customer support and management of your account.

 

We may associate any category of information with any other category of information and will treat the combined information as personal data in accordance with this policy for as long as it is combined. We do not disclose information about identifiable individuals to our advertisers, but we may provide them with anonymous aggregate information about our users (for example, we may inform them that a certain number of men aged under a certain age have clicked on their advertisement on any given day). We may also use such aggregate information to help advertisers reach the kind of audience they want to target (for example, women in a certain geographic area). We may make use of the personal data we have collected from you to enable us to comply with our advertisers’ wishes by displaying their advertisement to that target audience.

 

Disclosure of Your Information- We may disclose your personal information to third parties:  

• In the event that we sell or buy any business or assets, in which case we may disclose your personal data to the prospective seller or buyer of such business or assets;  

• If Urban or substantially all of its assets are acquired by a third party, in which case personal data held by it about its users will be one of the transferred assets;

• If we are under a duty to disclose or share your personal data in order to comply with any legal or regulatory obligation or request; or  

• In order to:  

• Enforce or apply the EULA and other agreements or to investigate potential breaches; or  

• Protect the rights, property or safety of Urban, the deseedating intellectual property rights, our users, or others. This includes exchanging information with other companies and organisations for the purposes of fraud protection and credit risk reduction.  

 

Where We Store Your Personal Data- While our primary hosting facilities are situated within the European Economic Area (“EEA”), the data that we collect from you may be transferred to, and stored and/or processed at a destination outside the EEA. By submitting your personal data, you agree to this transfer, storing or processing. We will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this privacy policy, and transfers outside the EEA will be protected by appropriate safeguards, namely the use of standard data protection clauses adopted or approved by the European Commission. Submitted information and other information collected by the Platform may be stored on secure servers operated by our external third party hosting suppliers, and the information will be treated in accordance with the privacy policy of such third party hosting suppliers. Unfortunately, the transmission of information via the internet is not completely secure. Although we will do our best to protect your personal data, we cannot guarantee the security of your data transmitted to us and any transmission is at your own risk. Once we have received your information, we will use strict procedures and security features to try to prevent unauthorised access. Certain Services include social networking, chat room or forum features. Ensure when using these features or communicating with any other user that you do not submit any personal data that you do not want to be seen, collected or used by other users.

 

Retaining and Deleting Personal Data- Personal data that we collect and/or process for any purposes shall not be kept for longer than is necessary for that purpose or those purposes. We will retain your personal data as follows:  

• Submitted Information will be retained for a maximum period of five years following termination of your membership;  

• Content Information and Location Information will be retained for a maximum period of two years following termination of your membership;  

• Device Information and Log information will be retained for a maximum period of two years following your relevant interaction with the Platform.  

Nothwitstanding the other provisions of this section, we may retain your personal data where such retention is necessary for compliance with a legal obligation to which we are subject, or in order to protect your vital interests or the vital interests of another natural person.  

 

Your Rights- In this section we have summarised the rights you have under data protection law. Some of the rights are complex, and not all of the details have been included in our summaries. Accordingly, you should read the relevant laws and guidance from the regulatory authorities for a full explanation of these rights. Your principal rights under data protection law are:  

• The right to access;  

• The right to rectification;  

• The right to erasure;  

• The right to restrict processing;  

• The right to object to processing;  

• The right to data portability;  

• The right to complain to a supervisory authority; and

You have the right to confirmation as to whether or not we process your personal data and, where we do, access to the personal data, together with certain additional information. That additional information includes details of the purposes of the processing, the categories of personal data concerned and the recipients of the personal data. Providing the rights and freedoms of others are not affected, we will supply to you a copy of your personal data. The first copy will be provided free of charge, but additional copies may be subject to a reasonable fee. You can access your personal data when logged into the Platform.

 

You have the right to have any inaccurate personal data about you rectified and, taking into account the purposes of the processing, to have any incomplete personal data about you completed.

 

In some circumstances you have the right to the erasure of your personal data without undue delay. Those circumstances include: the personal data are no longer necessary in relation to the purposes for which they were collected or otherwise processed; you withdraw consent to consent-based processing; you object to the processing under certain rules of applicable data protection law; the processing is for direct marketing purposes; and the personal data have been unlawfully processed. However, there are exclusions of the right to erasure. The general exclusions include where processing is necessary: for exercising the right of freedom of expression and information; for compliance with a legal obligation; or for the establishment, exercise or defence of legal claims.

 

In some circumstances you have the right to restrict the processing of your personal data. Those circumstances are: you contest the accuracy of the personal data; processing is unlawful but you oppose erasure; we no longer need the personal data for the purposes of our processing, but you require personal data for the establishment, exercise or defence of legal claims; and you have objected to processing, pending the verification of that objection. Where processing has been restricted on this basis, we may continue to store your personal data. However, we will only otherwise process it: with your consent; for the establishment, exercise or defence of legal claims; for the protection of the rights of another natural or legal person; or for reasons of important public interest.

You have the right to object to our processing of your personal data for direct marketing purposes (including profiling for direct marketing purposes). If you make such an objection, we will cease to process your personal data for this purpose.

You have the right to object to our processing of your personal data for scientific or historical research purposes or statistical purposes on grounds relating to your particular situation, unless the processing is necessary for the performance of a task carried out for reasons of public interest.

 

To the extent that the legal basis for our processing of your personal data is consent; or that the processing is necessary for the performance of a contract to which you are a party or in order to take steps at your request prior to entering into a contract, and such processing is carried out by automated means, you have the right to receive your personal data from us in a structured, commonly used and machine-readable format. However, this right does not apply where it would adversely affect the rights and freedoms of others.

 

If you consider that our processing of your personal information infringes data protection laws, you have a legal right to lodge a complaint with a supervisory authority responsible for data protection. You may do so in the EU member state of your habitual residence, your place of work or the place of the alleged infringement.

 

To the extent that the legal basis for our processing of your personal information is consent, you have the right to withdraw that consent at any time. Withdrawal will not affect the lawfulness of processing before the withdrawal.

Third Party Links- Our Platform may, from time to time, contain links to and from the websites of our partner networks, advertisers and affiliates (including, but not limited to, websites on which the Platform or the Services are advertised). If you follow a link to any of these websites, please note that these websites and any services that may be accessible through them have their own privacy policies and that we do not accept any responsibility or liability for these policies or for any personal data that may be collected through these websites or services, such as contact and location data. Please check these policies before you submit any personal data to these websites or use these services.  

 

Changes to Privacy Policy- Any changes we may make to our privacy policy in the future notified to you when you next start the App or sign in on the Websites. The new terms may be displayed on-screen and you may be required to read and accept them to continue your use of the Platform or the Services.
